Undertaking the planning and legal requirements for Housing Development in South Africa

    Providing the services of a One Stop Shop from undertaking a preliminary feasibility investigation,
    to the final transfer of land to beneficiaries (the planning and legal aspects are dealt with here).

MHP offers the entire spectrum of legal, planning and survey services required to plan for, design, develop and transfer land to housing beneficiaries.

The first step is to conduct a detailed land legal investigation to determine the ownership status of underlying properties and to identify impediments arising from conditions of title. This audit will include a field survey to identify the physical positions of all services affecting the land. These physical positions are compared with registered servitudes shown on diagrams or described in the Title Deeds, to identify gaps. These gaps are dealt with in the planning application.

Township applications are prepared using different formats to fit with the particular legislation used for the application. The most effective township development legislation is the Development Facilitations Act. MHP has successfully prepared several applications in terms of this Act, including:

  • Kwamgaga Housing Development outside of Durban - 1 400 sites.
  • Mdlebeni Housing Development near Stanger - 1 200 sites.
  • Nkwazi Development near Zinkwazi - 450 sites.
  • Kathide Development near Newcastle - 2 200 sites.
  • Sherwood Development in Durban (Jimmy Carter project) - 750 sites.

The physical surveying, conveyancing and sales administration functions are all undertaken by the MHP group.
